General Terms and Conditions of
Yorrxshire United GmbH – hereinafter referred to as “YORRX”
§1 Scope and Definition of Consumer
(1) The following General Terms and Conditions apply to all deliveries between Yorrxshire United GmbH, hereinafter referred to as “YORRX”, and the respective buyer via the sales platforms eBay, Amazon, https://www.yorrx.com , as well as generally for online and telephone inquiries and orders.
(2) A “CONSUMER” within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that cannot be attributed to their commercial or independent professional activity.
§2 Conclusion of Contract
(1) In the event of a contract being concluded, the contract shall be concluded with:

– The presentation of goods by YORRX on the internet or in other advertising materials does not constitute a legally binding offer, but merely a non-binding invitation to the consumer to place an order. By ordering the desired goods—whether by completing and submitting order data online, via email, fax, telephone, or post—the CONSUMER submits a binding offer to conclude a purchase contract with YORRX.
– In the event of typographical, printing, or calculation errors on the website or in other advertising materials, YORRX is not obliged to conclude a contract. If YORRX’s supplier fails to deliver the ordered goods despite a contractual obligation, if inventory levels are incorrect, or if the item is no longer available in the required quality, YORRX is likewise not obliged to conclude a contract. In such cases, the CONSUMER will be informed that the ordered product is not available.
§3 Prices, Shipping Costs, Payment, Due Date, and Collection
(1) The prices stated include statutory value-added tax (VAT) and other price components. Any additional packaging and shipping costs shall be charged separately.
(2) The consumer may choose to pay by advance payment, PayPal, or direct bank transfer. Cash payment is not possible.
(3) If the consumer chooses advance payment, they are obliged to pay the purchase price immediately after conclusion of the contract.
(4) Collection of goods is possible by prior arrangement with YORRX. Upon collection, the buyer shall inspect the goods for defects and thereby expressly waives any claims for damages and the right of return. Liability under the Product Liability Act and statutory warranty rights remain unaffected.
(5) Vouchers and discounts: A maximum of one voucher may be redeemed per order or purchase. Vouchers cannot be combined. Unless explicitly stated on the voucher, vouchers do not apply to already discounted goods. There is no legal entitlement to vouchers or discounts, and cash redemption is expressly excluded unless the voucher is a purchased monetary gift voucher. Vouchers expire no later than two years after the date of issue, unless stated otherwise.
§4 Delivery, Defects, and Transport Damage or Errors
(1) Unless expressly stated otherwise in the product description, all items offered by YORRX are ready for dispatch.
(2) If payment by advance payment has been agreed, goods will not be dispatched until payment has been confirmed by our banking institution or the respective payment service provider.
(3) Deliveries are possible worldwide. The shipping costs stated in the offer apply to the specifically listed countries. If shipping costs for other countries are not explicitly stated, they must be requested from YORRX. All country-specific charges (e.g. import duties, customs clearance, etc.) in the consumer’s country shall be borne by the CONSUMER.
(4) Upon delivery, shipment is made to the first house, apartment, or office door, provided appropriate access routes and road conditions are available (otherwise, delivery will be made to the nearest accessible location).
(5) If a product ordered by the CONSUMER is unexpectedly unavailable, YORRX is entitled to withdraw from the contract. In the event of non-availability, the CONSUMER will be informed by YORRX and all payments already made will be refunded immediately, without any further claims.
(6) If YORRX i) is in default of delivery; ii) carries out partial or incomplete deliveries; iii) delivers incorrect goods; or iv) delivery becomes impossible, and intent or gross negligence on the part of YORRX can be excluded, liability for damages (both direct and indirect) shall be excluded. General customer claims for repair or contract rescission remain unaffected. The customer may declare withdrawal from the contract after granting a reasonable grace period for subsequent performance.
(7) In the event of delivery delays due to reasons beyond YORRX’s control (force majeure, fault of third parties, etc.), the delivery period shall be extended appropriately. The customer will be informed accordingly. If the delay continues for more than four weeks after conclusion of the contract, either contracting party shall be entitled to withdraw from the contract and reclaim any payments made, without further claims.
(8) If delivery is not included in the product price as stated in the offer, delivery shall be made subject to a flat-rate shipping fee, the exact amount of which will be indicated separately at checkout.
(9) If goods are delivered with obvious damage to the packaging or contents, the customer must immediately report this to the carrier/freight service and refuse acceptance of the goods. The customer must inform YORRX of the defects or damage without delay.
(10) Hidden defects must be reported to YORRX immediately after discovery.
§5 Retention of Title
We retain ownership of the goods until full payment of the purchase price has been received.
§6 Right of Return / Right of Withdrawal / Withdrawal Information
(1) Right of Return (pursuant to §5g para. 2 KSchG):
As a consumer, you have the right to return unused goods received in their original packaging without stating any reason by returning the goods. The withdrawal period is one (1) month from the day on which you or a third party designated by you, who is not the carrier, takes possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email).

In the case of self-collection or shipment to third countries (countries outside the European Economic Area (EEA)), the right of return does not apply.
(2) Consequences of Return (pursuant to §5g para. 2 KSchG):
If you, as a consumer, withdraw from this contract, we shall refund all payments received from you for the value of the goods—excluding any stated delivery costs—without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. The refund will be made using the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first. You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. If the product has already been used or damaged, YORRX reserves the right to refund a reduced amount reflecting the diminished value. The deadline is met if you send back the goods before the expiry of the fourteen-day period. As a consumer, you shall bear the direct costs of returning the goods.
§7 Warranty
(1) The consumer’s claims against YORRX in the event of defects shall be governed by the statutory provisions within the legally prescribed time limits, unless deviations arise from the provisions set out below. Obvious defects must be reported by the consumer to YORRX in writing without delay, but no later than two weeks after receipt of the goods. Liability for consequential damages—such as when a defective product causes further damage—is excluded.
(2) Warranty claims shall be settled by YORRX, subject to availability, by replacement, repair, or a price reduction.
(3) The consumer shall have no claims against YORRX for damages caused by improper or non-contractual handling, storage, transport, installation, or use by the customer and/or the consumer. Improper or non-contractual handling is determined in particular by the manufacturer’s instructions.
(4) If the customer is a business customer and the ordered service is provided for their commercial operation, claims for defects shall expire one year after receipt of the goods.
(5) Warranty for Business Customers
If the purchase between YORRX and the buyer constitutes a commercial transaction, the buyer must immediately inspect the delivered goods for quality and quantity deviations and notify YORRX in writing of any apparent defects within one week of receipt of the goods; otherwise, warranty claims are excluded. Hidden defects must be reported to YORRX in writing within one week of discovery. Timely dispatch of the notice shall be sufficient to meet the deadline. In this case, the buyer bears the full burden of proof for all prerequisites of the claim, in particular for the defect itself, the time at which the defect was discovered, and the timeliness of the defect notification.
– In the event of defects, YORRX shall, at its own discretion, provide warranty service by repair or replacement delivery.
– The buyer’s claims for defects shall expire after one year. This limitation period does not apply to claims for damages.
(6) Free promotional items included with the goods or the purchased product are explicitly excluded from warranty claims.
§8 Liability
(1) YORRX shall only be liable for intent and gross negligence. It is the consumer’s responsibility to ensure the safekeeping of their products and their proper use in accordance with their intended purpose.
(2) If a culpable breach of duty caused by simple negligence results in the culpable violation of a material contractual obligation, YORRX’s liability for damages shall be limited to the foreseeable damage typically occurring in comparable cases. In all other respects, liability is excluded.
(3) Liability under the provisions of the Product Liability Act remains unaffected.
§9 Data Protection
(1) The processing of personal data is carried out in accordance with the legal bases set out in the General Data Protection Regulation (GDPR). Details of our data protection activities can be found in our Privacy Policy, which is available in the footer of the respective website or can be provided to you upon request.
(2) YORRX employees are subject to the confidentiality obligations of applicable laws. Routing and domain information must and may be disclosed where required. The consumer acknowledges that the data disclosed in the course of placing an order may be stored and processed by YORRX for the purposes of order processing, accounting, and customer records. Customer data is required and used by YORRX to comply with legal obligations and to process payments. Customer data will not be passed on to third parties unless this is strictly necessary for contract fulfillment or required by law.
§10 Contract Language and Governing Law
(1) German shall be the sole contractual language. Austrian law shall apply to the conclusion and performance of all contracts.
(2) If the buyer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of YORRX. The same applies if the consumer does not have a general place of jurisdiction in Austria, or if their place of residence or habitual residence is unknown at the time legal action is initiated.
(3) The applicability of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
